摘要

法律解释方法的位阶冲突是法学理论与司法实践中长期存在的核心问题之一，其对法律适用的统一性和权威性具有重要影响。本文以法律解释方法的位阶冲突为研究背景，旨在探讨不同解释方法在适用中的优先性及其协调路径。通过系统梳理文义解释、体系解释、目的解释等主要方法的理论基础，并结合典型案例分析，本文揭示了各方法在实际运用中可能产生的矛盾及其成因。通过明确各解释方法的功能定位并引入动态权衡原则，能够在一定程度上缓解位阶冲突，提升法律解释的科学性和合理性。本文的主要创新点在于提出了基于情境适应性的协调路径，强调在尊重法律文本原意的基础上兼顾社会变迁和价值导向，从而实现法律解释的稳定性与灵活性的统一。这一研究成果不仅丰富了法律解释学的理论框架，也为司法实践提供了更具操作性的指导方案。

Abstract

The conflict of legal interpretation methods is one of the long-standing core problems in legal theory and judicial practice, which has an important impact on the unity and authority of law application. Based on the research background of the hierarchical conflict of legal interpretation methods, this paper aims to explore the priority of different interpretation methods in application and their coordination paths. By systematically sorting out the theoretical basis of the main methods such as textual interpretation, system interpretation and purpose interpretation, and combining with the analysis of typical cases, this paper reveals the possible contradictions and causes of each method in practical application. By clarifying the functional positioning of each interpretation method and introducing the principle of dynamic balance, the conflict of rank can be alleviated to a certain extent, and the scientific and rational interpretation of law can be improved. The main innovation of this paper is to put forward a coordination path based on situational adaptability, emphasizing the consideration of social changes and value orientation on the basis of respecting the original meaning of legal texts, so as to achieve the unity of stability and flexibility of legal interpretation. This research not only enriches the theoretical fr amework of legal hermeneutics, but also provides a more operational guidance scheme for judicial practice.
