数字贸易规则中的“数据主权”博弈与协调 -国际经济与贸易专业

摘要

随着数字经济的蓬勃发展，数字贸易规则成为国际经贸治理的重要议题，其中“数据主权”作为核心概念，引发了国家间复杂的博弈与协调需求。本研究旨在探讨数字贸易规则中“数据主权”的内涵及其对全球治理的影响，并提出可行的协调机制。“数据主权”不仅是技术与经济问题，更涉及国家安全、文化价值和社会治理等多重维度，不同国家基于自身发展阶段和战略目标形成了多样化规则体系。本文创新性地提出了以“分级分类管理”为核心的协调框架，主张在尊重各国数据主权的基础上，构建灵活且包容的国际合作机制，以平衡自由流动与安全管控之间的矛盾。这一框架为解决当前数字贸易规则碎片化提供了新思路，同时为发展中国家参与全球数字治理提供了理论支持和实践指导。

The Game and Coordination of "Data Sovereignty" in Digital Trade Rules

Abstract

With the vigorous development of the digital economy, digital trade rules have become an important issue in international economic and trade governance, among which "data sovereignty" as the core concept has triggered complex game and coordination needs among countries. This study aims to explore the connotation of "data sovereignty" in digital trade rules and its impact on global governance, and propose feasible coordination mechanisms. "Data sovereignty" is not only a technical and economic issue, but also involves multiple dimensions such as national security, cultural values and social governance. Different countries have formed diversified rule systems based on their own development stages and strategic goals. This paper innovatively puts forward a coordination fr amework with "hierarchical and classified management" as the core, advocating the construction of a flexible and inclusive international cooperation mechanism on the basis of respecting the data sovereignty of various countries, so as to balance the contradiction between free flow and security control. This fr amework provides new ideas for addressing the fragmentation of current digital trade rules, while providing theoretical support and practical guidance for developing countries to participate in global digital governance.
