摘要
随着互联网技术的迅猛发展，网络平台著作权侵权问题日益凸显，“红旗标准”作为判断网络服务提供者是否应知用户侵权行为的重要依据，在司法实践中备受关注。本研究旨在探讨“红旗标准”在网络平台著作权侵权中的适用，以期为相关法律完善及司法实践提供理论支持。通过对国内外相关文献的梳理，结合我国现行法律法规与典型案例分析，研究发现“红旗标准”的适用存在认定标准模糊、主观性较强等问题。创新性地提出从侵权内容明显程度、权利人通知义务与平台注意义务三方面构建“红旗标准”的具体适用规则，明确不同类型网络平台在不同场景下的注意义务边界。研究结果表明，优化后的“红旗标准”能够更科学合理地界定网络服务提供者的责任，既保护著作权人的合法权益，又兼顾网络平台的发展需求，促进互联网产业健康有序发展，为解决网络平台著作权侵权问题提供了新的视角和路径。

Abstract
With the rapid development of Internet technology, copyright infringement issues on online platforms have become increasingly prominent. The "Red Flag Standard" has garnered significant attention in judicial practice as a crucial criterion for determining whether online service providers should have been aware of users' infringing activities. This study aims to explore the application of the "Red Flag Standard" in addressing copyright infringement on online platforms, providing theoretical support for legal improvements and judicial practices. By reviewing relevant domestic and international literature, and analyzing current laws and regulations along with typical cases in China, this research identifies issues such as ambiguous criteria and strong subjectivity in the application of the "Red Flag Standard." Innovatively, it proposes constructing specific application rules for the "Red Flag Standard" from three aspects: the obviousness of infringing content, the notification obligations of right holders, and the due diligence obligations of platforms. It clarifies the boundaries of due diligence obligations for different types of online platforms under various scenarios. The findings indicate that the optimized "Red Flag Standard" can more scientifically and reasonably define the responsibilities of online service providers, protecting the legitimate rights and interests of copyright holders while accommodating the developmental needs of online platforms, thereby promoting the healthy and orderly development of the Internet industry and offering new perspectives and approaches to resolving copyright infringement issues on online platforms.
