Abstract

  The promulgation of the Civil Code provides a new legal fr amework for the transfer and protection of land contract management rights. This study aims to explore the pathways for improving the system of transferring land contract management rights and its rights protection mechanisms under this new legal context. Through textual analysis of relevant provisions in the Civil Code, combined with field research and case studies, this paper systematically examines the primary issues existing in the current transfer of land contract management rights, including non-standardized transfer procedures, underdeveloped transfer markets, and inadequate protection of farmers' rights. The study finds that the Civil Code clarifies the nature of land contract management rights, further optimizes transfer methods, and strengthens the protection of farmers' land rights. The innovation lies in integrating theoretical research with empirical analysis, discussing from three dimensions: legislative interpretation, judicial practice, and social impact. It proposes recommendations such as establishing a diversified dispute resolution mechanism, improving the registration and filing system for transfers, and enhancing the service functions of grassroots organizations. The results indicate that the Civil Code provides a solid legal foundation for the transfer and protection of land contract management rights, but supporting policies and institutional innovations are still needed to ensure effective implementation, thereby achieving rational allocation of rural land resources and maximizing farmers' interests, promoting the smooth advancement of the rural revitalization strategy.
