摘要
家庭暴力作为社会问题，对受害者身心健康及社会稳定造成严重威胁，《中华人民共和国民法典》的颁布为家庭暴力受害者保护提供了新的法律依据。本研究旨在探讨民法典对家庭暴力受害者保护机制及其实施效果，基于文献研究与案例分析相结合的方法，梳理民法典中关于家庭暴力预防、制止、救助等规定，并选取典型地区进行实地调研获取一手资料。研究发现，民法典明确了家庭成员间的权利义务关系，将禁止家庭暴力纳入基本原则，确立了人身安全保护令制度，拓宽了救济途径，加强了公权力干预力度，体现了对家庭暴力受害者的全面保护理念。同时，在实施过程中也存在一些问题，如部分民众对民法典相关内容知晓度不高，相关部门协调配合有待加强等。本研究创新性地从民法典整体框架出发，系统剖析其对家庭暴力受害者保护机制，不仅丰富了相关理论研究，也为完善我国反家庭暴力法律体系、提高家庭暴力治理效能提供了有益参考。

Abstract
Domestic violence, as a social issue, poses a serious threat to the physical and mental health of victims and social stability. The promulgation of the Civil Code of the People's Republic of China provides new legal grounds for the protection of domestic violence victims. This study aims to explore the mechanisms and implementation effects of the Civil Code in protecting victims of domestic violence by combining literature review with case analysis, examining provisions related to prevention, cessation, and assistance of domestic violence within the Civil Code, and conducting field research in selected regions to obtain primary data. The findings indicate that the Civil Code clarifies the rights and obligations among family members, incorporates the prohibition of domestic violence into its fundamental principles, establishes the personal safety protection order system, broadens avenues for relief, and intensifies public authority intervention, reflecting a comprehensive protection philosophy for victims of domestic violence. However, issues exist during implementation, such as insufficient awareness of relevant Civil Code content among some citizens and the need for enhanced coordination among relevant departments. Innovatively approaching from the overall fr amework of the Civil Code, this study systematically analyzes its protective mechanisms for victims of domestic violence, enriching theoretical research and providing valuable references for improving China’s anti-domestic violence legal system and enhancing the efficiency of domestic violence governance.
