摘要
随着信息技术的迅猛发展，网络环境下的版权保护面临前所未有的挑战，传统著作权法难以完全适应数字化传播的特点。本研究旨在探讨网络环境下著作权法面临的困境及应对策略，通过文献分析、案例研究与比较法研究相结合的方法，深入剖析现行法律在网络版权保护中的适用性问题。研究发现，网络技术的发展使得侵权行为更加隐蔽且易于扩散，而现有立法在界定权利边界、规范网络服务提供者责任等方面存在不足。为此，本文提出构建以预防为主、救济为辅的综合保护体系，强调技术措施与法律制度相协调的重要性。创新之处在于引入区块链等新兴技术作为版权管理工具，并建议建立跨部门协作机制以提高执法效率。此外，针对网络环境下作品传播速度快、范围广的特点，主张优化许可制度，平衡创作者权益与公众利益，在保障权利人合法权益的同时促进文化产业健康发展，为完善我国网络版权保护制度提供了理论支持和实践参考。

Abstract
With the rapid development of information technology, the copyright protection under the network environment is facing unprecedented challenges, and the traditional copyright law is difficult to fully adapt to the characteristics of digital communication. This study aims to explore the dilemma of the copyright law under the network environment, and deeply analyze the applicability of the current law in the network copyright protection through the combination of literature analysis, case study and comparative law research. It is found that the development of network technology makes infringement more hidden and easy to spread, while the existing legislation has shortcomings in defining the boundary of rights and regulating the responsibility of network service providers. Therefore, this paper proposes to build a comprehensive protection system with prevention first and relief as a supplement, and emphasizes the importance of coordination between technical measures and legal system. The innovation lies in the introduction of emerging technologies such as blockchain as copyright management tools, and suggests the establishment of cross-departmental collaboration mechanisms to improve law enforcement efficiency. In addition, in view of the characteristics of fast dissemination and wide range of works in the network environment, it advocates optimizing the licensing system, balancing the rights and interests of creators and the public interests, protecting the legitimate rights and interests of rights holders and at the same time promoting the healthy development of cultural industry, and provides theoretical support and practical reference for the improvement of the network copyright protection system in China.
