摘要
《民法典》的颁布实施为物权变动制度提供了新的规范框架,研究该制度旨在深入剖析其在新时代背景下的内涵与外延。以《民法典》相关条款为依据,结合法学理论研究、案例分析以及比较法研究的方法展开探讨。通过对大量司法案例的梳理,发现实践中存在诸多关于物权变动理解与适用的问题,如不动产登记效力、动产交付规则等。本研究明确了物权变动区分原则的具体适用范围,强调了基于法律行为的物权变动需遵循法定要件,非基于法律行为的物权变动则注重事实行为或事件的发生。创新之处在于将意思主义与形式主义相结合,构建起符合我国国情的物权变动模式,既保障交易安全又兼顾效率。同时,对特殊类型的物权变动进行了深入解读,如善意取得制度中受让人善意的判断标准等,为司法实践提供明确指引,有助于统一裁判尺度,促进物权交易秩序稳定发展,提高物尽其用的效能,在完善我国物权法律体系方面具有重要意义。

Abstract
The promulgation and implementation of the Civil Code have provided a new normative fr amework for the system of property rights changes, aiming to thoroughly analyze its connotations and extensions in the context of the new era. Based on relevant provisions of the Civil Code, this study explores the system through legal theory research, case analysis, and comparative law studies. By examining a large number of judicial cases, numerous issues regarding the understanding and application of property rights changes in practice have been identified, such as the effectiveness of real estate registration and rules for the delivery of movable property. This research clarifies the specific scope of application of the distinction principle in property rights changes, emphasizing that property rights changes based on legal acts must follow statutory requirements, while those not based on legal acts focus on the occurrence of factual acts or events. The innovation lies in combining voluntarism with formalism to construct a property rights change model suited to China’s national conditions, ensuring both transactional security and efficiency. Additionally, this study provides an in-depth interpretation of special types of property rights changes, such as the criteria for determining the good faith of transferees in the doctrine of bona fide acquisition, offering clear guidance for judicial practice, helping to unify adjudication standards, promoting the stable development of property rights transactions, enhancing the efficiency of resource utilization, and playing a significant role in improving China’s property rights legal system.

Abstract
