消费者权益保护的法律问题及对策研究


摘要

随着全球经济一体化的加速发展和电子商务的蓬勃兴起,消费者权益保护问题日益凸显。在快速变化的市场环境中,消费者面临着商品质量参差不齐、虚假广告泛滥、售后服务不到位以及个人信息泄露等多重风险。这些问题不仅损害了消费者的合法权益,也制约了市场经济的健康发展。特别是在数字化转型的大背景下,个人信息保护成为消费者权益保护的新焦点。因此,深入研究消费者权益保护的法律问题,探索有效的法律对策,对于维护市场秩序、促进经济可持续发展具有重要意义。本文旨在探讨消费者权益保护的法律问题及其对策。首先概述了消费者权益保护法律的基本概念及法理基础,随后深入分析了当前存在的商品质量问题、虚假宣传、售后服务难题以及个人信息保护漏洞等法律挑战。针对这些问题,本文提出了加强商品质量监管、规范市场宣传行为、完善售后服务法规及强化个人信息保护等多方面的对策。通过借鉴国内外先进经验,结合我国实际情况,本文旨在为构建更加完善的消费者权益保护法律体系提供理论支持和实践指导。

Abstract

With the accelerated development of global economic integration and the vigorous rise of e-commerce, the protection of consumer rights and interests has become increasingly prominent. In the rapidly changing market environment, consumers are faced with multiple risks, such as the uneven quality of goods, the flood of false advertising, inadequate after-sales service and personal information leakage. These problems not only damage the legitimate rights and interests of consumers, but also restrict the healthy development of the market economy. Especially in the context of digital transformation, personal information protection has become a new focus of the protection of consumer rights and interests. Therefore, it is of great significance to maintain the market order and promote the sustainable development of consumers and explore effective legal countermeasures to protect the economy. This paper aims to explore the legal issues of consumer rights protection and its countermeasures. Firstly, the basic concept and legal basis of the protection of consumer rights and interests are summarized, and then the existing legal challenges such as commodity quality problems, false publicity, after-sales service problems and personal information protection loopholes are deeply analyzed. In view of these problems, this paper puts forward the countermeasures of strengthening the supervision of commodity quality, standardizing the market publicity behavior, improving the after-sales service regulations and strengthening the protection of personal information. By drawing on the advanced experience at home and abroad and combining with the actual situation of China, this paper aims to provide theoretical support and practical guidance for the construction of a more perfect consumer rights protection law system.
