摘要
校园暴力行为一直是社会关注的焦点问题，其法律实践面临着诸多困境。本文深入探讨了校园暴力行为在法律实践中的挑战，包括证据收集与认定的困难、责任认定与追究的难题、法律救济与赔偿的局限以及法律预防与教育的缺失。针对这些困境，本文提出了相应的对策和建议。针对证据收集与认定的困难，建议加强校园监控系统的建设，提高师生举报意识，并设立专门调查机构，同时引入技术手段辅助证据认定，以确保证据的真实性和有效性。其次，针对责任认定与追究的难题，建议明确责任认定标准，加强跨部门合作，严格责任追究程序，并提高司法效率，确保责任得到及时、准确的认定和追究。此外，针对法律救济与赔偿的局限，本文提出完善赔偿机制，引入社会救助，加大惩罚力度，并建立健全的追诉制度，以更好地保护受害者的权益。最后，针对法律预防与教育的缺失，建议加强法律教育，推广反校园暴力教育，提高教师和家长对校园暴力问题的认识和处理能力，以构建更加和谐、安全的校园环境。

Abstract
Campus violence has always been the focus of social concern, and its legal practice is faced with many difficulties. This paper deeply discusses the challenges of school violence in legal practice, including the difficulties of evidence collection and identification, the difficulties of responsibility identification and investigation, the limitations of legal relief and compensation, and the lack of legal prevention and education. In view of these dilemmas, this paper puts forward the corresponding countermeasures and suggestions. In view of the difficulties in evidence collection and identification, it is suggested to strengthen the construction of the campus monitoring system, improve the awareness of teachers and students to report, and set up a special investigation agency, and introduce technical means to assist the evidence identification, to ensure the authenticity and effectiveness of the evidence. Secondly, in view of the difficult problem of responsibility identification and investigation, it is suggested to clarify the standards of responsibility identification, strengthen cross-departmental cooperation, strictly enforce the accountability procedures, and improve the judicial efficiency, to ensure that the responsibility is timely and accurate identification and investigation. In addition, in view of the limitations of legal relief and compensation, this paper proposes to improve the compensation mechanism, introduce social assistance, increase the punishment intensity, and establish a sound prosecution system, so as to better protect the rights and interests of the victims. Finally, in view of the lack of legal prevention and education, it is suggested to strengthen legal education, promote anti-school violence education, improve the teachers and parents' understanding and ability to deal with the problem of school violence, so as to build a more harmonious and safe campus environment.
