摘 要
随着互联网技术的迅猛发展，网络平台著作权侵权问题日益凸显，“通知-删除”规则作为应对这一问题的重要机制，在实践中面临诸多挑战。本研究旨在探讨现行“通知-删除”规则在网络环境下的适用困境，并提出优化路径。通过对国内外相关法律法规、司法判例及学术研究成果的系统梳理，结合对典型网络平台运营模式的深入分析，发现现有规则存在通知标准模糊、删除程序缺乏规范性、权利人与平台间责任分配不合理等问题。基于此，本研究创新性地提出了构建分级分类的通知体系、完善删除程序细则、引入第三方评估机制等优化建议。研究结果表明，优化后的“通知-删除”规则能够更有效地平衡著作权保护与信息自由传播之间的关系，既保障了权利人的合法权益，又避免了平台过度审查的风险。同时，该规则有助于降低平台运营成本，提高处理效率，为构建健康有序的网络版权生态提供了理论依据和实践指导，对促进我国数字文化产业健康发展具有重要意义。

Abstract
With the rapid development of Internet technology, copyright infringement issues on online platforms have become increasingly prominent. The "notice-and-takedown" rule serves as a critical mechanism to address these challenges but faces numerous obstacles in practice. This study aims to explore the applicability dilemmas of the current "notice-and-takedown" rule in the online environment and propose optimization paths. Through a systematic review of relevant domestic and international laws, judicial precedents, and academic research findings, combined with an in-depth analysis of typical online platform operating models, it is found that existing rules suffer from ambiguous notification standards, lack of procedural norms for takedown, and unreasonable allocation of responsibilities between right holders and platforms. Based on these findings, this study innovatively proposes the establishment of a tiered and categorized notification system, refinement of takedown procedure details, and introduction of third-party evaluation mechanisms as optimization recommendations. The results indicate that the optimized "notice-and-takedown" rule can more effectively balance copyright protection and the free dissemination of information, safeguarding the legitimate rights and interests of right holders while avoiding excessive censorship by platforms. Additionally, this rule helps reduce operational costs for platforms, improves processing efficiency, and provides theoretical foundations and practical guidance for building a healthy and orderly online copyright ecosystem, which is of great significance for promoting the healthy development of China's digital cultural industry.
