网络著作权保护中的“权利穷竭原则”适用问题 -法学专业

摘要

随着互联网技术的迅猛发展，数字作品传播方式日益多样化，网络著作权保护面临诸多新挑战，权利穷竭原则在网络环境下的适用问题成为理论与实务界关注的重点。本研究旨在探讨权利穷竭原则在网络著作权保护中的适用，通过文献分析、案例研究和比较法研究等方法，深入剖析该原则在网络环境中的内涵、适用条件及边界。研究发现，传统权利穷竭原则在网络环境下存在适用困境，如数字产品交易中难以界定首次销售行为，且网络传输特性使得权利人对作品后续流通失去控制。创新性地提出构建适应网络环境的权利穷竭规则体系，明确数字作品合法获取后的使用范围，平衡权利人与社会公众利益。主要贡献在于为解决网络著作权保护中权利穷竭原则适用难题提供理论依据，为立法完善和司法实践提供参考，促进数字文化产业健康发展，保障创作者权益的同时兼顾消费者正当权益，推动形成开放包容、公平合理的网络版权秩序。

Abstract

With the rapid development of Internet technology, the dissemination methods of digital works have become increasingly diversified, posing numerous new challenges to the protection of online copyright. The application of the exhaustion of rights principle in the network environment has become a focal point for both theoretical and practical circles. This study aims to explore the applicability of the exhaustion of rights principle in online copyright protection. Through literature analysis, case studies, and comparative legal research, this paper delves into the connotations, conditions, and boundaries of this principle in the network environment. It is found that the traditional exhaustion of rights principle faces applicability dilemmas in the network environment, such as the difficulty in defining the first sale in digital product transactions, and the characteristics of network transmission make it challenging for right holders to control the subsequent circulation of works. Innovatively, this study proposes the construction of an exhaustion of rights rule system adapted to the network environment, clarifying the scope of use after lawful acquisition of digital works, thereby balancing the interests of right holders and the general public. The primary contribution lies in providing theoretical support for addressing the challenges in applying the exhaustion of rights principle in online copyright protection, offering references for legislative improvements and judicial practices, promoting the healthy development of the digital cultural industry, safeguarding creators' rights while considering consumers' legitimate interests, and fostering an open, inclusive, fair, and reasonable online copyright order.
