摘 要
随着互联网技术的迅猛发展，网络文学产业呈现出蓬勃发展的态势，但与此同时，网络文学版权保护面临着诸多法律困境。为探究其法律困境并寻求解决路径，本研究以网络文学版权保护为切入点，综合运用文献研究法、案例分析法和比较研究法等方法，深入剖析了网络文学版权保护在立法层面存在法律法规不完善、滞后于行业发展的问题，在执法层面存在监管难度大、侵权成本低与维权成本高的矛盾，在司法层面存在举证困难、赔偿标准不明确等状况。通过对比国内外相关法律制度，借鉴国外先进经验，提出构建完善的网络文学版权保护法律法规体系，加强行政监管力度，建立多元化的纠纷解决机制，利用区块链等新兴技术强化版权认证与追溯等创新性解决路径。本研究不仅有助于改善网络文学版权保护现状，还为其他数字文化产业的版权保护提供了有益参考，对促进网络文学产业健康有序发展具有重要意义。

Abstract
With the rapid development of Internet technology, the online literature industry has shown a vigorous growth trend. However, copyright protection for online literature faces numerous legal challenges. To explore these legal difficulties and seek solutions, this study focuses on the copyright protection of online literature, employing methods such as literature review, case analysis, and comparative research. It delves into the legislative issues of incomplete and outdated laws that lag behind industry development, the enforcement challenges of high regulatory difficulty and the contradiction between low infringement costs and high维权 costs, as well as judicial problems such as difficulties in providing evidence and unclear compensation standards. By comparing domestic and international legal systems and drawing on advanced foreign experiences, this study proposes innovative solutions including establishing a comprehensive legal fr amework for online literature copyright protection, enhancing administrative supervision, creating diversified dispute resolution mechanisms, and utilizing emerging technologies like blockchain to strengthen copyright authentication and traceability. This research not only contributes to improving the current state of online literature copyright protection but also provides valuable references for copyright protection in other digital cultural industries, playing a significant role in promoting the healthy and orderly development of the online literature industry.
