论环境景观利益的法律保护 -法学专业

摘要

随着城市化进程的加速和人们环境意识的提升，环境景观利益逐渐成为法学研究的重要领域。本文旨在探讨环境景观利益的法律保护问题，以期为相关立法与司法实践提供理论支持。通过对国内外环境景观保护相关法律法规、政策文件及典型案例进行系统梳理，深入剖析当前我国环境景观利益保护面临的挑战，如法律概念模糊、保护范围界定不清、公众参与机制不完善等。在此基础上提出构建专门性的环境景观利益保护法律体系，明确其内涵外延，确立政府主导、社会共治的多元主体协同治理模式，强化公众参与监督机制，创新性地引入生态服务价值评估体系作为衡量标准，为环境景观利益受损提供科学合理的补偿依据。研究表明，完善的法律保护制度能够有效促进人与自然和谐共生，实现环境景观资源可持续利用，对推动生态文明建设具有重要意义。

Abstract

With the acceleration of urbanization and the enhancement of people's environmental awareness, environmental landscape benefits have gradually become an important field of legal research. The purpose of this paper is to discuss the legal protection of environmental landscape interests in order to provide theoretical support for relevant legislation and judicial practice. Through systematic analysis of domestic and foreign laws and regulations, policy documents and typical cases related to environmental landscape protection, in-depth analysis of the current challenges facing the protection of environmental landscape interests in China, such as vague legal concept, unclear definition of the scope of protection, and imperfect public participation mechanism. On this basis, it is proposed to construct a specialized legal system for the protection of environmental landscape interests, clarify its connotation and extension, establish a multi-subject collaborative governance model with government leading and social co-governance, strengthen the public participation supervision mechanism, and innovatively introduce the ecological service value evaluation system as a measurement standard to provide scientific and reasonable compensation basis for the damage of environmental landscape interests. The research shows that a perfect legal protection system can effectively promote the harmonious coexistence between man and nature and realize the sustainable utilization of environmental landscape resources, which is of great significance for promoting the construction of ecological civilization.
