摘 要
随着依法治国战略的深入推进,公务员法律制度作为国家治理体系的重要组成部分,其权利保障问题日益受到关注。本研究旨在探讨当前公务员法律制度中权利保障的现状、问题及优化路径,以期为完善相关法律法规提供理论支持和实践指导。我国公务员法律制度在权利保障方面已取得显著进展,但仍存在权利界定模糊、救济机制不健全等问题。通过对比分析,本文提出应进一步明确公务员基本权利范围,完善权利救济程序,并构建多元化的监督体系。本研究的创新点在于将权利保障置于法治政府建设的整体框架下进行考察,强调权利与义务的平衡以及制度设计的科学性。同时,研究首次引入国际经验与中国实践的双向互动视角,为构建更加公平、透明、高效的公务员法律制度提供了新思路。总体而言,本研究不仅深化了对公务员权利保障的认识,也为推动我国公务员管理法治化进程作出了积极贡献。

Abstract
With the deepening of the strategy of governing the country according to law, the legal system of civil servants, as an important part of the national governance system, has attracted more and more attention. The purpose of this study is to explore the status quo, problems and optimization path of the protection of rights in the current civil servant legal system, in order to provide theoretical support and practical guidance for the improvement of relevant laws and regulations. The legal system of civil servants in China has made remarkable progress in the protection of rights, but there are still some problems such as vague definition of rights and imperfect relief mechanism. Through comparative analysis, this paper proposes that we should further clarify the scope of civil servants' basic rights, improve the right relief procedures, and build a diversified supervision system. The innovation of this study is to place the protection of rights under the overall fr amework of the construction of the rule of law government, emphasizing the balance of rights and obligations and the scientific design of the system. At the same time, the study introduces for the first time a two-way interactive perspective between international experience and Chinese practice, providing new ideas for building a more fair, transparent and efficient civil service legal system. On the whole, this study not only deepens the understanding of civil servant rights protection, but also makes a positive contribution to promoting the process of civil servant management rule of law in our country.
