摘 要
数字时代信息技术迅猛发展，网络环境下的作品传播方式发生深刻变革，版权保护面临前所未有的挑战。本文旨在探讨数字时代版权保护的法律挑战并提出相应对策，以期为完善我国版权保护制度提供理论支持。通过对国内外相关法律法规、司法案例以及学术研究成果进行系统梳理与分析，结合对数字产业从业者和版权管理机构的实地调研，深入剖析数字环境下版权侵权的新特点，如侵权主体多元化、侵权行为隐蔽化等。研究发现，现行版权法在应对数字技术带来的新问题时存在诸多不足，例如难以适应快速变化的技术手段，在界定数字作品的独创性标准方面缺乏明确依据等。为此，本文创新性地提出构建适应数字时代的版权保护体系，包括完善立法以涵盖新兴领域，强化行政监管力度，建立多元化的纠纷解决机制，鼓励技术创新应用于版权保护，倡导全社会形成尊重版权的文化氛围。这些措施有助于平衡创作者权益与公众利益，在促进数字文化产业健康发展的同时，实现版权保护法律制度的有效性和前瞻性。

Abstract
In the digital era, the rapid development of information technology has profoundly transformed the methods of work dissemination in network environments, presenting unprecedented challenges to copyright protection. This paper aims to explore the legal challenges of copyright protection in the digital age and propose corresponding countermeasures to provide theoretical support for improving China’s copyright protection system. By systematically reviewing and analyzing relevant domestic and international laws, judicial cases, and academic research findings, combined with field surveys of digital industry practitioners and copyright management institutions, this study delves into the new characteristics of copyright infringement in the digital environment, such as the diversification of infringing entities and the concealment of infringing activities. The research reveals that the current copyright law is inadequate in addressing new issues brought by digital technology, for instance, it struggles to adapt to rapidly changing technical means and lacks clear criteria for defining the originality standards of digital works. In response, this paper innovatively proposes the construction of a copyright protection system suited to the digital age, including refining legislation to cover emerging areas, strengthening administrative supervision, establishing diversified dispute resolution mechanisms, encouraging the application of technological innovations in copyright protection, and advocating for the creation of a cultural atmosphere that respects copyrights across society. These measures can help balance the rights of creators with public interests, promoting the healthy development of the digital cultural industry while ensuring the effectiveness and foresight of copyright protection laws.
