非婚生子的社会保障权利研究 -法学专业

摘要

随着社会观念变迁和家庭结构多样化，非婚生子现象日益普遍，其社会保障权利问题成为亟待解决的社会议题。本研究旨在探讨非婚生子在现行社会保障体系中的法律地位与权益保障状况，通过文献分析、案例研究及实证调查相结合的方法，系统梳理国内外相关法律法规与政策实践，剖析非婚生子在医疗、教育、抚养等关键领域面临的现实困境。研究发现，当前我国非婚生子在享受基本公共服务方面存在诸多制度性障碍，特别是在户籍登记、医疗保险等方面遭遇歧视性待遇。基于此，本文提出构建平等包容的社会保障体系框架，建议从立法层面消除身份差异带来的不平等待遇，建立以儿童利益最大化为原则的综合保障机制。创新之处在于首次将非婚生子作为独立研究对象进行系统考察，并引入国际比较视角，为完善我国未成年人保护制度提供理论依据与实践参考，对推动社会公平正义具有重要现实意义。

Abstract

As societal values and family structures evolve, the phenomenon of children born out of wedlock has become increasingly common, making their social security rights an urgent social issue that needs to be addressed. This study aims to explore the legal status and rights protection of children born out of wedlock within the current social security system. By employing a combination of literature analysis, case studies, and empirical research, this paper systematically examines relevant domestic and international laws and policy practices, analyzing the practical challenges faced by these children in critical areas such as healthcare, education, and upbringing. The findings reveal that children born out of wedlock in China encounter numerous institutional barriers in accessing basic public services, particularly discriminatory treatment in household registration and medical insurance. Based on these insights, this paper proposes the establishment of an equitable and inclusive social security fr amework, recommending legislative reforms to eliminate unequal treatment arising from differences in birth status and advocating for a comprehensive protection mechanism grounded in the principle of maximizing children's best interests. The novelty of this research lies in its systematic examination of children born out of wedlock as an independent subject of study and the incorporation of an international comparative perspective, providing theoretical foundations and practical references for improving China's minor protection system and promoting social equity and justice.
