摘 要
非婚生子的教育权平等性是现代社会亟待深入探讨的重要议题。随着社会观念变迁和家庭结构多元化,非婚生育现象日益普遍,但相关法律保障体系尚不完善,导致非婚生子女在教育机会均等、教育资源获取等方面面临诸多挑战。本研究旨在通过系统梳理国内外相关法律法规与政策文本,结合实证调查数据,分析非婚生子女在学前教育、义务教育及高等教育各阶段所面临的现实困境及其成因。采用文献研究法、问卷调查法、访谈法以及案例分析法,对全国10个省市300个样本家庭进行调研,结果显示非婚生子女在入学资格审查、学籍管理、升学推荐等环节存在隐形歧视现象,且缺乏有效的权益救济渠道。创新之处在于首次构建了涵盖法律保护、社会支持、家庭教育三个维度的综合评价体系,并提出建立专门的非婚生子女权益保障机构、完善相关立法、加强公众教育等针对性建议,为推动教育公平提供理论依据与实践参考,强调应从人权视角出发,确保每个孩子都能享有平等接受优质教育的权利,促进社会和谐发展。

Abstract
The equality of educational rights for children born out of wedlock is an important issue that requires in-depth exploration in modern society. As social perceptions evolve and family structures diversify, non-marital births have become increasingly common; however, the legal protection system remains inadequate, leading to numerous challenges for these children in terms of equal access to educational opportunities and resources. This study aims to systematically examine relevant domestic and international laws and policies, combined with empirical survey data, to analyze the practical difficulties and underlying causes faced by children born out of wedlock at various stages of education, including preschool, compulsory education, and higher education. Utilizing methods such as literature review, questionnaire surveys, interviews, and case analysis, this research surveyed 300 sample families across 10 provinces and municipalities in China. The findings indicate that these children encounter covert discrimination in aspects like admission qualification reviews, student record management, and college recommendation processes, and lack effective channels for rights protection. An innovative contribution of this study is the establishment of a comprehensive evaluation system encompassing three dimensions: legal protection, social support, and family education. It also proposes targeted recommendations such as establishing specialized institutions for protecting the rights of children born out of wedlock, improving relevant legislation, and enhancing public education. These measures aim to provide theoretical foundations and practical references for promoting educational equity, emphasizing the importance of ensuring every child's right to receive quality education from a human rights perspective, thereby fostering harmonious social development.
