摘要

非婚生子的探视权问题日益成为社会关注的焦点，随着现代社会家庭结构多元化发展，非婚生育现象逐渐增多，由此引发的亲子关系确认及权利保障问题亟待解决。本研究旨在探讨非婚生子探视权相关法律制度，通过文献分析、案例研究和比较法研究相结合的方法，系统梳理国内外相关立法与司法实践，剖析现行法律框架下存在的不足。研究发现，我国现行法律法规对非婚生子探视权的规定较为原则，缺乏可操作性细则，在实际执行中面临诸多挑战，如身份确认程序复杂、权益保障机制不健全等。通过对典型判例的深入分析，揭示了司法实践中存在的标准不统一、裁量尺度差异较大等问题。本研究创新性地提出构建专门针对非婚生子探视权的法律体系，强调应从立法层面明确非婚生父母双方的权利义务关系，建立简便快捷的身份确认机制，完善配套的社会支持体系，确保非婚生子女能够获得稳定持续的情感关怀与成长环境，为推动我国婚姻家庭法律制度的完善提供了理论参考和实践依据。

Abstract

The issue of visitation rights for non-marital children has increasingly become a focal point of societal concern. As modern society experiences diversification in family structures, the phenomenon of non-marital births is gradually on the rise, leading to pressing issues regarding the confirmation of parent-child relationships and the protection of rights that need to be addressed. This study aims to explore the legal system concerning visitation rights for non-marital children by integrating literature analysis, case studies, and comparative law research, systematically examining relevant legislation and judicial practices both domestically and internationally, and analyzing the deficiencies within the current legal fr amework. It is found that China’s existing laws and regulations provide only general stipulations on visitation rights for non-marital children, lacking detailed and operational guidelines, thus facing numerous challenges in practical implementation such as complicated identity confirmation procedures and an incomplete rights protection mechanism. In-depth analysis of typical court cases reveals issues in judicial practice, including inconsistent standards and significant differences in discretionary measures. Innovatively, this study proposes the establishment of a specialized legal system targeting visitation rights for non-marital children, emphasizing the need to clarify the rights and obligations of non-marital parents at the legislative level, establish a simple and efficient identity confirmation mechanism, and improve supporting social support systems, ensuring that non-marital children can receive stable and continuous emotional care and a nurturing environment. This provides theoretical references and practical evidence for the improvement of China’s marriage and family legal system.
