离婚案件中未成年子女抚养制度研究 -法学专业

摘要

本研究针对离婚案件中未成年子女抚养制度进行了深入探讨。随着社会变迁与家庭结构的多样化，离婚率逐年攀升，未成年子女的抚养问题日益凸显其重要性。本研究旨在通过分析现行抚养制度，提出改进建议，以更好地保障未成年子女的权益。通过对比分析，本研究发现当前制度存在诸多不足，如抚养权判定标准模糊、抚养费计算方式不合理、探视权执行难度大等。针对这些问题，本研究创新性地提出了一系列改进措施。建议明确抚养权判定的具体标准，综合考虑子女的最佳利益和父母双方的实际情况。优化抚养费的计算方式，确保费用既能满足子女成长需要，又不会给非主要抚养方造成过重负担。提出完善探视权执行机制，减少因探视问题引发的纠纷。

Abstract

In this study, the minor child support system in divorce cases is deeply discussed. With the social changes and the diversification of family structure, the divorce rate is increasing year by year, and the issue of raising minor children has become increasingly important. The purpose of this study is to analyze the current support system and put forward some suggestions to better protect the rights and interests of minor children. Through comparative analysis, this study finds that there are many deficiencies in the current system, such as fuzzy criteria for determining custody rights, unreasonable ways of calculating maintenance fees, and difficult enforcement of visitation rights. In response to these problems, this study innovatively puts forward a series of improvement measures. It is suggested that the specific criteria of custody judgment should be clarified, and the best interests of children and the actual situation of both parents should be considered comprehensively. Optimise the way maintenance payments are calculated to ensure that they meet the growing needs of children without placing an undue burden on non-primary caregivers. To improve the enforcement mechanism of visitation right and reduce the disputes caused by visitation.
