摘 要
本文探讨了现代司法实践中证明责任与提供证据责任这两个核心概念，阐述了它们的定义、分配原则、法律后果以及它们之间的联系与区别。研究强调了证明责任在确保诉讼公正和法律权威中的重要性，并详细讨论了提供证据责任对诉讼活动的影响。文章指出两者虽紧密联系，但在责任性质、范围及法律后果上有所不同。针对现有制度的不足，提出了完善建议，包括明确责任分配、增强制度透明度、提升证据规则灵活性及加强法律从业人员培训，以优化诉讼程序和提高司法效率。最后，文章总结了研究成果，并提出了未来研究方向。

Abstract：This paper discusses the two core concepts of burden of proof and burden of evidence in modern judicial practice, and expounds their definitions, distribution principles, legal consequences, and the connection and difference between them. The study emphasizes the importance of the burden of proof in ensuring the justice and legal authority of litigation, and discusses in detail the influence of the burden of proof on litigation activities. The article points out that although the two are closely related, they are different in the nature, scope and legal consequences of liability. In view of the shortcomings of the existing system, suggestions are put forward to improve it, including clarifying the allocation of responsibilities, enhancing the transparency of the system, enhancing the flexibility of the rules of evidence and strengthening the training of legal practitioners, so as to optimize the litigation procedure and improve judicial efficiency. Finally, the paper summarizes the research results and puts forward the future research direction.
