摘 要
本文探讨了房屋租赁合同解除的法律程序、后果及补救措施。首先概述了房屋租赁合同的定义、行使基础及解除的主要依据,随后详细阐述了行使解除权的法律程序,包括确认解除权、发出并确保送达解除通知等步骤。文章进一步分析了房屋租赁合同解除后可能面临的法律后果,如一方过错导致的合同解除、损失赔偿请求、信用记录受影响以及不确定性增加等。最后,针对这些后果,提出了相应的补救措施,包括过错方承担全责、合理确定赔偿范围、加强信用管理以及制定应急预案等。本研究旨在为房屋租赁双方提供法律指导,减少合同纠纷,促进租赁市场的健康发展。

Abstract
This paper discusses the legal procedures, consequences and remedial measures for the termination of the house lease contract. First of all, it summarizes the definition, the exercise basis and the main basis for the termination of the house lease contract, and then expounds the legal procedure for the exercise of the right of termination in detail, including the steps of confirming the right of termination, issuing and ensuring the service of the notice of termination. This paper further analyzes the legal consequences it may face after the termination of the house lease contract, such as the termination of the contract caused by the fault of one party, the request for the compensation for the loss, the impact of the credit record and the increase of uncertainty. Finally, in view of these consequences, corresponding remedial measures are put forward, including the fault party assuming full responsibility, reasonably determining the scope of compensation, strengthening credit management and formulating emergency plan. The study aims to provide legal guidance for both parties, reduce contract disputes and promote the healthy development of the rental market.
