在市场经济体制下,企业破产作为一种经济现象,对职工权益产生了深远的影响。本文以“企业破产程序中职工权益保护研究”为主题,旨在探讨破产企业中职工权益的保护问题,并提出相应的法律建议。文章首先概述了企业破产程序与职工权益的相关概念,并分析了破产对职工权益的具体影响,如劳动合同终止、拖欠工资和社会保险、失业及再就业困难以及对职工心理和生活造成的压力等。随后,文章对现行法律框架下职工权益的保护机制进行剖析,包括劳动合同保护、工资支付及福利保障、职业安全健康监管等方面。在此基础上,指出了现行职工权益保护面临的挑战,如劳动合同不规范、工资待遇不透明、工作环境与安全无保障、社会保险和福利缺失等。针对这些问题,本文提出了一系列法律建议,包括加强劳动合同法律规制、提升工资透明度与公平性、明确劳动合同必备条款和完善社会保险及福利体系等。文章认为,通过完善相关法律政策,能够更有效地保护破产企业中职工的合法权益,促进社会和谐稳定。

Abstract

Under the market economy system, enterprise bankruptcy, as an economic phenomenon, has a profound impact on the rights and interests of employees. This paper takes "Research on the protection of employees' rights and interests in bankruptcy proceedings" as the theme, aims to explore the protection of employees' rights and interests in bankrupt enterprises, and put forward corresponding legal suggestions. This paper first summarizes the relevant concepts of enterprise bankruptcy procedure and workers' rights and interests, and analyzes the specific effects of bankruptcy on workers' rights and interests, such as termination of labor contract, arrears of wages and social insurance, unemployment and re-employment difficulties, and the pressure on workers' psychology and life. Then, the article analyzes the protection mechanism of workers' rights and interests under the current legal fr amework, including labor contract protection, wage payment and welfare security, occupational safety and health supervision. On this basis, it points out the challenges facing the protection of workers' rights and interests, such as non-standard labor contracts, opaque wages, insecure working environment and safety, lack of social insurance and welfare. To solve these problems, this paper puts forward a series of legal suggestions, including strengthening the legal regulation of labor contracts, enhancing the transparency and fairness of wages, clarifying the necessary clauses of labor contracts, and improving the social insurance and welfare system. The article holds that by improving relevant laws and policies, the legitimate rights and interests of employees in bankrupt enterprises can be protected more effectively and social harmony and stability can be promoted.
