摘 要
本文旨在探讨我国遗嘱继承制度的现状、存在的不足以及完善的路径。首先，概述了我国遗嘱继承制度的基本框架，包括遗嘱的设立与有效性、遗嘱继承人的确定以及遗嘱执行与遗产分配等方面。随后，针对当前制度在实际运行中存在的问题进行了深入分析，如遗嘱设立形式的规定不完善、遗嘱执行与监督机制的缺失、遗嘱继承人权益保障不足以及遗产分配制度的不完善等。针对这些问题，本文提出了相应的完善建议。首先，应完善遗嘱设立形式的规定，以适应现代社会的发展需要，确保遗嘱的真实性和有效性。其次，建立遗嘱执行与监督机制，加强遗嘱执行的程序化和规范化，保障遗嘱内容的正确执行。同时，加强遗嘱继承人权益的保障，明确遗嘱继承人的权益范围，并提供有效的法律救济途径。最后，完善遗产分配制度，确保遗产分配的公平性和合理性，避免家庭纠纷的发生。本文的研究对于完善我国遗嘱继承制度、促进家庭和谐与社会稳定具有重要的现实意义。通过深入分析当前制度存在的问题并提出具体的完善建议，可以为相关部门制定政策提供参考，为我国遗嘱继承制度的进一步完善提供理论支持。

Abstract
This paper aims to explore the current situation, shortcomings and perfect path of the testamentary inheritance system in China. Firstly, it summarizes the basic fr amework of the testamentary inheritance system in China, including the establishment and validity of the will, the determination of the will heir, the execution and distribution of the inheritance. Subsequently, the problems existing in the actual operation of the current system are analyzed in depth, such as the imperfect provisions of the form of will establishment, the lack of will execution and supervision mechanism, the lack of protection of the rights and interests of the testamentary heirs, and the imperfection of the inheritance distribution system. In view of these problems, this paper puts forward the corresponding suggestions for improvement. First of all, the provisions of the form of will establishment should be improved to meet the development needs of modern society and ensure the authenticity and validity of the will. Secondly, the establishment of will execution and supervision mechanism, strengthen the procedure and standardization of will execution, to ensure the correct execution of the will content. At the same time, strengthen the protection of the rights and interests of testamentary successors, clarify the scope of the rights and interests of testamentary successors, and provide effective legal relief channels. Finally, the inheritance distribution system should be improved to ensure the fairness and rationality of the inheritance distribution and avoid the occurrence of family disputes. The study of this paper is of great practical significance for improving the will inheritance system and promoting family harmony and social stability. Through the in-depth analysis of the problems existing in the current system and putting forward specific suggestions for improvement, it can provide reference for the relevant departments to formulate policies, and provide theoretical support for the further improvement of the testamentary inheritance system in China.
