  我国房地产市场近年来经历了深刻调整,部分房地产企业陷入破产困境,购房人权益保护成为亟待解决的重要问题。本研究旨在探讨房地产企业破产过程中购房人权利的法律保护机制,通过文献分析、案例研究和比较法研究等方法,系统梳理现行法律法规,剖析司法实践中的难点与争议点。研究发现,当前立法存在诸多不足,如优先权范围界定模糊、执行程序衔接不畅等,导致购房人在破产程序中处于弱势地位。通过对典型案件的深入分析,本文提出应明确购房人债权的优先性,建立专门的购房人权益保障基金,并完善相关配套制度。同时,建议优化破产管理人选任机制,确保购房人参与破产程序的权利。本研究创新性地构建了购房人权利保护的多层次框架,不仅为理论研究提供了新视角,也为司法实践提供了可操作性的解决方案,对维护社会稳定和促进房地产市场健康发展具有重要意义。研究成果填补了现有研究在购房人权利保护方面的空白,为相关政策制定提供了重要参考依据。

Abstract

  The real estate market in China has undergone profound adjustments in recent years, with some property developers falling into bankruptcy, making the protection of homebuyers' rights an urgent issue to address. This study aims to explore the legal protection mechanisms for homebuyers' rights during the bankruptcy of real estate enterprises. Through methods such as literature analysis, case studies, and comparative legal research, this paper systematically reviews existing laws and regulations and analyzes difficulties and contentious points in judicial practice. The findings reveal that current legislation has numerous deficiencies, including ambiguous definitions of priority claims and poor coordination in enforcement procedures, which place homebuyers at a disadvantage in bankruptcy proceedings. By conducting an in-depth analysis of typical cases, this paper proposes clarifying the priority of homebuyers' claims, establishing a dedicated fund for protecting homebuyers' rights, and improving relevant supporting systems. Additionally, it recommends optimizing the selection mechanism for bankruptcy administrators to ensure homebuyers' participation in bankruptcy processes. Innovatively, this study constructs a multi-level fr amework for protecting homebuyers' rights, offering new perspectives for theoretical research and providing operational solutions for judicial practice. It is significant for maintaining social stability and promoting the healthy development of the real estate market. The research outcomes fill the gap in existing studies on the protection of homebuyers' rights and provide crucial references for policy formulation.
