网络文学著作权保护的现状与改进建议
摘 要
随着互联网技术的迅猛发展，网络文学产业规模不断扩大，但著作权保护面临诸多挑战。本文旨在探讨网络文学著作权保护的现状并提出改进建议，通过文献研究法、案例分析法等方法，对现行法律法规在网络文学著作权保护中的适用性进行剖析。研究发现，当前存在侵权成本低、维权成本高、证据固定难等问题，且网络环境下的传播特点使侵权行为更加隐蔽复杂。针对这些问题，本文创新性地提出构建专门的网络文学著作权保护平台，该平台集版权登记、监测、维权于一体，利用区块链技术确保数据不可篡改，提高证据效力；同时建议完善相关法律法规，明确网络环境下著作权的界定标准，降低维权门槛，加大对侵权行为的惩处力度。此外，还强调加强行业自律，建立网络文学创作者与平台间的良性互动机制，从源头上预防侵权行为的发生，为网络文学产业健康发展提供有力保障。这一系列措施不仅有助于解决现有问题，也为其他数字文化产业的著作权保护提供了参考借鉴。

Abstract
With the rapid development of Internet technology, the scale of online literature industry is continuously expanding, yet it faces numerous challenges in copyright protection. This paper aims to explore the current status of copyright protection for online literature and propose improvement suggestions. Through methods such as literature research and case analysis, this study examines the applicability of existing laws and regulations in protecting online literature copyrights. The findings reveal that current issues include low costs of infringement, high costs of rights protection, and difficulties in evidence fixation, which are further complicated by the characteristics of online dissemination making infringing activities more concealed and complex. In response to these problems, this paper innovatively proposes the establishment of a specialized online literature copyright protection platform that integrates functions of copyright registration, monitoring, and rights protection. By utilizing blockchain technology, this platform ensures data immutability and enhances the effectiveness of evidence. Meanwhile, it is suggested to improve relevant laws and regulations, clarify the criteria for defining copyrights in the online environment, lower the threshold for rights protection, and increase penalties for infringements. Additionally, emphasis is placed on strengthening industry self-discipline and establishing a positive interaction mechanism between online literature creators and platforms to prevent infringing behaviors at the source, thereby providing strong support for the healthy development of the online literature industry. These measures not only help address existing problems but also offer reference for copyright protection in other digital cultural industries.
