数字图书馆著作权风险防控机制研究
摘 要
随着信息技术的迅猛发展，数字图书馆作为信息资源的重要存储与传播平台，在为用户提供便捷服务的同时，也面临着诸多著作权风险。本研究旨在构建完善的数字图书馆著作权风险防控机制，以保障数字图书馆健康稳定发展。通过对国内外相关法律法规、政策文件以及典型案例进行深入分析，并结合数字图书馆实际运营情况，采用文献研究法、案例分析法等方法探究数字图书馆在资源获取、加工处理、传播利用等环节存在的著作权风险类型及其成因。研究发现，数字图书馆著作权风险主要源于法律法规滞后于技术发展、权利人权益保护意识增强、数字资源管理难度加大等因素。为此，提出建立以预防为主的风险预警体系，完善数字图书馆内部管理制度，加强与权利人的合作沟通，积极参与国际规则制定等防控措施。

Abstract
With the rapid development of information technology, digital library, as an important storage and dissemination platform of information resources, also faces many copyright risks while providing users with convenient services. This study aims to build a perfect copyright risk prevention and control mechanism of digital library to ensure the healthy and stable development of digital library. Through the relevant laws and regulations at home and abroad, policy documents and typical cases, and combined with the actual operation situation of digital library, using the literature research method, case analysis method to explore the digital library in resource acquisition, processing, transmission and use of copyright risk types and its causes. It is found that the copyright risk of digital library is mainly due to the lag of laws and regulations in the development of technology, the increasing awareness of rights holders, and the increasing difficulty of digital resource management. To this end, it is proposed to establish a risk early warning system based on prevention, improve the internal management system of digital library, strengthen the cooperation and communication with the right holders, and actively participate in the formulation of international rules and other prevention and control measures.
