摘 要
随着我国经济快速发展和社会结构深刻变革,劳动关系日益复杂化、多样化,劳动争议案件数量持续增长且类型趋于多元化,传统的劳动争议调解机制面临诸多挑战。为此,本研究旨在探讨新时代背景下劳动争议调解机制的完善路径,以期构建更加高效、公正、和谐的劳动争议解决体系。通过对国内外相关文献的系统梳理,结合对全国多个省市劳动仲裁机构的实地调研和问卷调查,分析当前劳动争议调解机制存在的问题,如调解组织建设滞后、调解员专业素质参差不齐、调解程序缺乏规范性等。基于此,提出创新性的完善建议,包括建立多元化的调解主体格局,强化调解员职业化培训体系,优化调解程序衔接机制,引入信息化技术手段提升调解效率。研究发现,通过上述措施能够有效提高劳动争议调解的成功率和公信力,为构建和谐劳动关系提供坚实的制度保障,其成果不仅丰富了劳动法学理论研究,更为相关政策制定提供了重要参考依据。

Abstract
With the rapid economic development and profound social structural changes in China, labor relations have become increasingly complex and diversified, leading to a continuous increase in the number of labor dispute cases and a trend towards diversification in case types. The traditional labor dispute mediation mechanism is facing numerous challenges. This study aims to explore the pathways for improving the labor dispute mediation mechanism under the new era context, in order to construct a more efficient, fair, and harmonious labor dispute resolution system. By systematically reviewing relevant domestic and international literature, and combining field research and questionnaire surveys conducted at multiple provincial and municipal labor arbitration institutions across the country, this study analyzes existing problems in the current labor dispute mediation mechanism, such as lagging construction of mediation organizations, uneven professional qualities among mediators, and lack of standardization in mediation procedures. Based on these findings, innovative improvement suggestions are proposed, including establishing a diversified mediation subject structure, strengthening the professional training system for mediators, optimizing the connection mechanisms of mediation procedures, and introducing information technology to enhance mediation efficiency. The study concludes that these measures can effectively improve the success rate and credibility of labor dispute mediation, providing solid institutional guarantees for building harmonious labor relations. Moreover, the outcomes not only enrich the theoretical research in labor law but also offer important references for policy-making.
