摘 要
随着互联网技术的迅猛发展，互联网医疗服务逐渐兴起并深刻改变传统医疗模式，但其在法律监管方面面临诸多挑战，如服务资质审核、数据安全保护、医疗责任界定等，为解决这些问题以保障互联网医疗服务健康发展成为重要课题。本研究旨在探索互联网医疗服务的法律监管与创新路径，基于文献研究法和案例分析法，梳理国内外互联网医疗服务发展现状及法律监管政策，剖析现存问题。研究发现我国互联网医疗服务存在法律法规体系不完善、监管主体职责不清、行业自律机制缺乏等问题。针对上述问题提出构建完善的法律法规体系，明确监管主体及其职责，强化行业自律，建立多元协同监管机制等创新路径。这不仅有助于规范互联网医疗服务市场秩序，保障医患双方权益，还能为相关政策制定提供理论依据与实践参考，对推动互联网医疗服务持续健康发展具有重要意义。

Abstract
With the rapid development of Internet technology, internet-based medical services have emerged and profoundly transformed traditional healthcare models. However, these services face numerous challenges in legal supervision, including service qualification review, data security protection, and determination of medical liability. Addressing these issues to ensure the healthy development of internet-based medical services has become an important research topic. This study aims to explore the legal supervision and innovative pathways for internet-based medical services by employing literature review and case analysis methods. It examines the current status and regulatory policies of internet-based medical services both domestically and internationally, analyzing existing problems. The research reveals that China's internet-based medical services suffer from an incomplete legal fr amework, unclear responsibilities of supervisory bodies, and a lack of industry self-regulation mechanisms. In response to these issues, this study proposes establishing a comprehensive legal system, clarifying the roles and responsibilities of supervisory bodies, strengthening industry self-regulation, and developing a multi-party collaborative supervision mechanism. These innovative pathways not only help to standardize the market order of internet-based medical services and protect the rights and interests of both medical providers and patients but also provide theoretical foundations and practical references for policy-making, which is of great significance for promoting the sustainable and healthy development of internet-based medical services.
