妨害安全驾驶罪司法适用问题研究 -法学专业

摘要

妨害安全驾驶罪作为《中华人民共和国刑法修正案（十一）》新增罪名，旨在规制公共交通工具行驶过程中妨害安全驾驶的行为。本文聚焦该罪名司法适用中的争议问题，通过梳理相关立法背景与理论依据，分析当前司法实践中存在的认定标准不统一、证据采信困难等问题。司法机关在处理此类案件时存在对“暴力”手段理解偏差、危害后果认定模糊等现象，亟需明确细化的司法解释。本文创新性地提出构建以危险程度为核心的风险评估体系，为准确界定犯罪提供量化标准；同时建议完善证据收集指引，确保执法规范化。通过对妨害安全驾驶罪司法适用的系统研究，不仅有助于解决当前司法实践中的困惑，更为维护公共交通安全提供了坚实的法律保障，推动了相关领域法学理论的发展。

Abstract

The crime of interfering with safe driving, as a new charge in the Amendment (XI) of the Criminal Law of the People's Republic of China, aims to regulate the behavior of interfering with safe driving during the running of public transport vehicles. This paper focuses on the controversial issues in the judicial application of this crime, through combing the relevant legislative background and theoretical basis, and analyzes the problems existing in the current judicial practice, such as the inconsistent identification standards and the difficulty in obtaining evidence. When dealing with such cases, there are some phenomena such as the misunderstanding of "violent" means and the vague identification of harmful consequences, which need a clear and detailed judicial interpretation. This paper innovatively proposes to construct a risk assessment system with risk degree as the core to provide quantitative standards for accurately defining crimes. At the same time, it is suggested to improve the evidence collection guidelines to ensure the standardization of law enforcement. Through the systematic study of the judicial application of the crime of interfering with safe driving, it not only helps to solve the confusion in the current judicial practice, but also provides a solid legal guarantee for maintaining public transportation safety, and promotes the development of legal theories in related fields.
