摘要

限制民事行为能力人侵权责任探讨旨在深入分析我国现行法律框架下，限制民事行为能力人在侵权行为中的责任认定问题。随着社会经济快速发展和公民权利意识增强，涉及未成年人及精神障碍者等特殊群体的侵权案件日益增多，亟需完善相关法律规定以保障各方权益。本研究基于民法典及相关司法解释，采用文献研究与案例分析相结合的方法，系统梳理国内外理论成果，剖析典型判例，探究限制民事行为能力人侵权责任的构成要件、归责原则及其监护人的责任分担机制。研究表明，现行法律在责任界定方面存在模糊地带，导致司法实践中出现同案不同判现象。通过对比分析域外立法经验，提出构建符合中国国情的侵权责任体系建议，强调应根据行为人的认知能力和行为后果综合判断其责任承担，并明确监护人在教育、监管方面的补充责任。本研究创新性地引入心理学评估作为责任判定依据之一，为完善我国限制民事行为能力人侵权责任制度提供理论支持与实践参考，对促进司法公正具有重要意义。

Abstract

This study aims to delve into the issue of tort liability for persons with limited civil capacity within the fr amework of China's current legal system. With the rapid development of the social economy and the enhanced awareness of citizens' rights, tort cases involving special groups such as minors and individuals with mental disabilities have increased significantly, necessitating the improvement of relevant laws to protect the rights and interests of all parties. Based on the Civil Code and related judicial interpretations, this research employs a combination of literature review and case analysis to systematically examine theoretical achievements both domestically and internationally, analyze typical court rulings, and explore the elements constituting tort liability for persons with limited civil capacity, the principles of attribution of liability, and the mechanisms for sharing responsibility among guardians. The findings indicate that ambiguities in the current legal provisions regarding liability definition lead to inconsistent judicial decisions in similar cases. By comparing foreign legislative experiences, this study proposes recommendations for establishing a tort liability system suited to China's national conditions, emphasizing the need to assess liability based on a comprehensive evaluation of the actor's cognitive abilities and the consequences of their actions, while clearly defining the supplementary responsibilities of guardians in education and supervision.
