摘要

非婚生子抚养费的强制执行问题日益凸显，随着社会观念变迁及家庭结构多样化，非婚生育现象增多，由此引发的抚养费纠纷频发。本研究旨在探讨非婚生子抚养费强制执行中的法律困境与解决路径，通过实证分析和规范研究相结合的方法，以某地区法院2015 - 2020年相关案件为样本，深入剖析执行难的原因。研究发现，现行立法存在规定不明确、程序繁琐等问题，且社会对非婚生子女权益保护意识淡薄，导致被执行人逃避责任现象普遍。创新之处在于构建了涵盖立法完善、司法优化和社会协同的多层次解决方案，提出设立专门执行机构、简化申请流程、强化信用惩戒等具体措施。研究结果表明，完善的制度设计和社会支持体系能够有效提高抚养费执行效率，保障非婚生子女合法权益，促进社会公平正义，为我国未成年人权益保护提供有益借鉴，推动相关法律法规的修订和完善，具有重要的理论价值和现实意义。

Abstract

The enforcement of child support payments for children born out of wedlock has become an increasingly prominent issue. As societal attitudes evolve and family structures diversify, the phenomenon of non-marital births has increased, leading to a rise in disputes over child support payments. This study aims to explore the legal challenges and potential solutions in the enforcement of child support for non-marital children, employing a combination of empirical analysis and normative research. Using cases from a regional court between 2015 and 2020 as samples, this research delves into the underlying reasons for the difficulties in enforcement. The findings reveal that current legislation suffers from ambiguities and cumbersome procedures, while societal awareness regarding the protection of non-marital children's rights remains low, resulting in widespread evasion of responsibility by obligors. An innovative aspect of this study is the development of a multi-level solution fr amework encompassing legislative improvements, judicial optimization, and social collaboration. Specific measures proposed include establishing specialized enforcement agencies, streamlining application processes, and enhancing credit penalties. The results indicate that well-designed institutional fr ameworks and robust social support systems can significantly improve the efficiency of child support enforcement, safeguard the legitimate rights and interests of non-marital children, and promote social equity and justice. This research provides valuable insights for the protection of minors' rights in China and contributes to the revision and improvement of relevant laws and regulations, thereby possessing significant theoretical and practical implications.
