随着社会结构和家庭形态的多样化，家庭法中的子女抚养权条款面临着修订和完善的迫切需求。本文提出了具体建议，包括明确抚养权的界定与内容、强化父母共同责任、增加儿童参与机制，以及适应家庭多样性的法律条款。特别强调了对非婚生子女和同性伴侣家庭的法律认可，以体现法律的包容性和公平性。在实施策略方面，文章讨论了法律修订的程序与方法、法律宣传与公众教育、法律实施的监督与评估，以及跨部门合作与协调的重要性。这些策略旨在确保法律修订过程的规范化、科学化，并促进法律的有效实施和社会的广泛接受。最后，文章总结了研究的主要发现，并对未来的研究方向提出了展望。通过这些完善建议，旨在推动家庭法与时俱进，更好地服务于社会和家庭，尤其是保护未成年子女的合法权益。

Abstract

With the diversification of social structure and family form, the provisions of child custody in family law are facing the urgent need of revision and improvement. The paper makes specific recommendations, including clarifying the definition and content of custody rights, strengthening joint parental responsibility, increasing child participation mechanisms, and legal provisions to accommodate family diversity. Special emphasis was placed on the legal recognition of children born out of wedlock and families of same-sex couples to reflect the inclusiveness and fairness of the law. In terms of implementation strategy, the paper discusses the procedure and method of law revision, legal publicity and public education, supervision and evaluation of law implementation, and the importance of cross-departmental cooperation and coordination. These strategies aim to ensure a standardized and scientific process for law revision, and promote the effective implementation of the law and its wide acceptance by society. Finally, the main findings of the study are summarized, and the future research direction is proposed. Through these improvement proposals, the aim is to promote family law to keep pace with The Times and better serve the society and the family, especially to protect the legitimate rights and interests of minor children.
