摘 要
本研究通过对体育竞技中公平竞争法律问题的深入探讨，旨在构建一个全面而系统的法律框架以维护体育竞技的公平与正义。明确了体育竞技公平性的定义，并梳理了公平竞争的法律基础和国际体育法中的相关原则。随后，我们深入分析了体育竞技中公平竞争所面临的法律问题，包括兴奋剂使用、赛事操纵、不正当竞争行为和商业利益冲突等。针对这些问题，我们提出了相应的法律对策，包括加强法律规制与惩罚、建立严格的监管体系、强化公平竞争教育与培训以及规范商业活动与保护运动员权益等。同时，我们也提出了一系列促进公平竞争的建议，如建立公正的仲裁机制、完善仲裁程序、加强仲裁人员的独立性与专业性、促进体育组织的透明度、规范财务管理和报告以及增强决策过程的公开性等。还强调了社会公众在维护体育竞技公平竞争中的重要作用，建议通过开展公平竞争教育、媒体宣传与正面引导等方式，提升公众对公平竞争的认识和意识。通过本研究，我们旨在为体育竞技的公平竞争提供坚实的法律保障，促进体育运动的健康发展，维护运动员的合法权益，同时也为体育组织、运动员、教练员、裁判员以及广大体育爱好者提供一个公平、公正、透明的竞技环境。

Abstract
Through the deep discussion of fair competition law in sports competition, this study aims to construct a comprehensive and systematic legal fr amework to maintain the fairness and justice of sports competition. The definition of the fairness of sports competition is clarified, and the legal basis of fair competition and the relevant principles in the international sports law are sorted out. Subsequently, we analyzed in depth on the legal issues faced by fair competition in sports competition, including doping use, competition manipulation, unfair competition behavior and commercial conflicts of interests. In view of these problems, we put forward corresponding legal countermeasures, including strengthening legal regulation and punishment, establishing a strict supervision system, strengthening the education and training of fair competition, standardizing commercial activities and protecting the rights and interests of athletes. At the same time, we have also put forward a series of suggestions to promote fair competition, such as establishing a fair arbitration mechanism, improving the arbitration procedure, strengthening the independence and professionalism of arbitrators, promoting the transparency of sports organizations, standardizing financial management and reporting, and enhancing the openness of the decision-making process. It also emphasized the important role of the public in maintaining fair competition in sports competitions, and suggested that the public's awareness and awareness of fair competition should be enhanced by means of fair competition education, media publicity and positive guidance. Through this study, we aim to provide a solid legal guarantee for the fair competition of sports competition, promote the healthy development of sports, safeguard the legitimate rights and interests of athletes, and also provide a fair, just and transparent competitive environment for sports organizations, athletes, coaches, referees and the majority of sports fans.
