摘 要
本研究深入探讨了企业社会责任的法律规制问题。基于相关理论基础，对企业社会责任的定义、重要性以及国际法与国内法视角下的规定进行了系统梳理。接着，详细分析了企业社会责任的法律规制机制，包括法规体系的构建、法律效力的强化以及政府在其中的角色与职责。进一步地，研究指出了当前企业社会责任法律规制面临的问题，如法律要求不明确、监管机制不健全、法律责任过轻以及利益相关者参与不足等。针对这些问题，本研究提出了完善企业社会责任法律规制的对策，包括明确法律规定、加强监管与执法、加重法律责任以及促进利益相关者合作等。这些对策旨在构建一个更加完善、有效和可持续的法律规制体系，以推动企业积极履行社会责任，实现经济、社会和环境的和谐发展。研究还展望了企业社会责任法律规制的发展趋势。随着全球化和经济一体化的深入发展，企业社会责任的法律规制正逐步从自愿性向强制性转变，强制性立法的增加成为必然趋势。此外，法律责任与道德责任的融合、从单一责任向综合责任拓展以及多维度责任体系的构建等也是未来发展的重要方向。供应链社会责任的纳入和从国内规制向国际协同转变也将成为未来研究的重点。

Abstract
This study explores the legal regulation of CSR. Based on the relevant theoretical basis, the definition and importance of corporate social responsibility and the provisions from the perspective of international law and domestic laws are systematically sorted out. Then, the legal regulation mechanism of corporate social responsibility is analyzed in detail, including the construction of the legal system, the strengthening of the legal effect, and the role and responsibility of the government in it. Further, the research points out the current problems facing the legal regulation of corporate social responsibility, such as unclear legal requirements, imperfect supervision mechanism, too light legal responsibility and insufficient participation of stakeholders. In view of these problems, this study puts forward the countermeasures to improve the legal regulation of corporate social responsibility, including clarifying the legal provisions, strengthening the supervision and law enforcement, increasing the legal responsibility, and promoting the stakeholder cooperation. These countermeasures aim to build a more perfect, effective and sustainable legal regulation system, so as to promote enterprises to actively fulfill their social responsibilities and realize the harmonious development of economy, society and environment. The research also prospects the development trend of corporate social responsibility legal regulation. With the deepening development of globalization and economic integration, the legal regulation of corporate social responsibility is gradually changing from voluntary to compulsory, and the increase of compulsory legislation has become an inevitable trend. In addition, the integration of legal responsibility and moral responsibility, the expansion from single responsibility to comprehensive responsibility, and the construction of multi-dimensional responsibility system are also important directions for future development. The inclusion of social responsibility of supply chain and the transformation from domestic regulation to international coordination will also become the focus of future research.
