Abstract
Through the further exploration of the overtime system from the perspective of labor law, this study reveals the problems existing in the current overtime system, and puts forward the corresponding solution strategies and suggestions. The basic principle of labor law and the legal definition of overtime work system are expounded in detail, and the close connection between overtime work and the protection of workers' rights and interests is clarified. Subsequently, from the perspective of labor law, the problems existing in the overtime system were comprehensively analyzed, including unclear legal provisions, non-standard payment of overtime pay, insufficient protection of workers' rights and interests, and ineffective supervision and law enforcement. We propose specific strategies to address these problems. It is suggested to improve relevant laws and regulations, clarify the identification standards, payment standards and restriction conditions for overtime work to standardize the payment of overtime pay and ensure reasonable economic compensation; strengthen the protection of workers' rights and interests, strengthen legal education and legal aid to workers, improve their awareness of rights protection; strengthen supervision and law enforcement, establish sound supervision mechanism and law enforcement system and ensure the effective implementation of overtime system. In terms of suggestions to improving the overtime system, this study puts forward specific suggestions such as strengthening the implementation and supervision of overtime laws and regulations, strengthening the law enforcement and improving the supervision mechanism. At the same time, it is also suggested to build a reasonable overtime compensation mechanism, clear compensation standards and flexible compensation methods, so as to better protect the legitimate rights and interests of workers. This study aims to provide theoretical support and practical guidance for solving the problems existing in the current overtime system through the in-depth study of the overtime system from the perspective of labor law, so as to promote the continuous improvement of the labor law and the effective protection of workers' rights and interests.
