摘 要
随着信息技术的飞速发展和全球互联网的普及，电子商务已成为商业活动的重要形式。电子商务合同作为电子商务交易的法律基础，其法律适用问题日益凸显。由于电子商务合同的虚拟性、即时性和跨国界等特性，传统合同的法律框架已难以满足其需求，导致在合同履行、争议解决等方面存在诸多挑战。因此，本研究针对电子商务合同的法律问题展开深入探讨，旨在解决电子商务合同在履行、争议解决等方面面临的挑战。通过对电子商务合同的定义、特点、法律适用问题等进行分析，本研究提出了完善电子商务合同法律适用的国际与国内统一标准、建立与传统合同法律适用的协调机制、强化跨境电子商务合同中的法律适用选择与冲突解决机制等对策。本研究不仅有助于保障交易双方的权益，促进电子商务的健康发展，也为电子商务合同的法律制度建设提供了理论支持和实践指导。

Abstract
With the rapid development of information technology and the popularization of the global Internet, e-commerce has become an important form of business activities. As the legal basis of e-commerce transaction, the legal application of e-commerce contract has become increasingly prominent. Due to the virtuality, immediacy and cross-border characteristics of e-commerce contracts, the legal fr amework of traditional contracts has been difficult to meet its needs, leading to many challenges in contract performance, dispute settlement and other aspects. Therefore, this study conducts an in-depth discussion on the legal issues of e-commerce contracts, aiming to solve the challenges faced by e-commerce contracts in their performance and dispute resolution. Through the definition of e-commerce contract, characteristics, applicable law problem analysis, this study puts forward the perfect electronic commerce contract law applicable international and domestic unified standard, establish and the traditional contract law applicable coordination mechanism, strengthen cross-border e-commerce contract law applicable choice and conflict resolution mechanism. This study not only helps to protect the rights and interests of both parties, promote the healthy development of e-commerce, but also provides theoretical support and practical guidance for the construction of the legal system of e-commerce contracts.
