摘 要
本文旨在探讨农民工权益保护的法律路径。农民工作为城市建设和发展的重要力量，其权益保护问题日益受到社会关注。本文首先阐述了农民工权益保护的理论基础，包括劳动法的基本原则、相关行政法规与政策支持以及司法解释与实践发展。接着，详细分析了农民工权益的内容，包括劳动报酬权益、工作条件与职业安全、社会保险与福利等，并对农民工权益保护的现状进行了深入探讨。研究发现，当前农民工权益保护面临法律法规不完善、法律执行不力、农民工法律意识淡薄以及社保权益保护不到位等法律问题。针对这些问题，本文提出了农民工权益保护的法律路径。具体而言，需要完善法律法规体系，确保农民工的合法权益得到法律的有效保障；加强法律执行和监管，确保法律法规得到有效执行；提高农民工的法律意识和素质，增强他们维护自身权益的能力；完善社会保险和福利制度，为农民工提供更加全面的保障。通过本文的研究，旨在为农民工权益保护提供法律层面的理论支持和实践指导，促进农民工权益保护工作的深入开展，为实现城乡一体化和社会和谐稳定做出贡献。

Abstract
This paper aims to explore the legal path for the protection of the rights and interests of migrant workers. As an important force in urban construction and development, the protection of the rights and interests of migrant workers has been increasingly concerned by the society. This paper first expounds the theoretical basis of the protection of migrant workers' rights and interests, including the basic principles of labor law, relevant administrative regulations and policy support, and the development of judicial interpretation and practice. Then, the contents of the rights and interests of migrant workers are analyzed in detail, including the rights and interests of labor remuneration, working conditions and occupational safety, social insurance and welfare, etc., and the current situation of the rights and interests protection of migrant workers is discussed deeply. The study found that the protection of the rights and interests of migrant workers is faced with legal problems such as imperfect laws and regulations, ineffective enforcement of laws, weak legal awareness of migrant workers and inadequate protection of social security rights and interests. In view of these problems, this paper puts forward the legal path of protecting migrant workers' rights and interests. Specifically, it is necessary to improve the legal and regulation system to ensure that the legitimate rights and interests of migrant workers are effectively protected by law; strengthen the law enforcement and supervision to ensure the effective enforcement of laws and regulations; improve the legal awareness and quality of migrant workers and enhance their ability to safeguard their own rights and interests; and improve the social insurance and welfare system to provide more comprehensive protection for migrant workers. Through the research of this paper, it aims to provide theoretical support and practical guidance for the protection of migrant workers 'rights and interests at the legal level, promote the in-depth development of the protection of migrant workers' rights and interests, and make contributions to the realization of urban and rural integration and social harmony and stability.
