摘 要
本研究通过深入剖析网络安全法律制度的理论基础、功能作用以及国际实践，旨在全面揭示网络安全法律制度的构建现状及其面临的挑战。研究定义了网络安全法律制度的内涵，并探讨了其基本原则，包括保护网络空间主权、维护国家安全、保障社会公共利益以及促进网络健康发展等。在此基础上，进一步分析了网络安全法律制度在维护网络安全、促进网络健康发展以及保障公民权益等方面的功能与作用。通过对比美国、欧盟以及中国等国家和地区的网络安全法律制度，本研究发现各国在网络安全立法、执法以及国际合作等方面存在显著的差异和共性。同时，研究也揭示了当前网络安全法律制度构建中存在的问题，包括立法滞后、执行困难、国际合作不足以及公众法律意识不足等。针对这些问题，本研究提出了网络安全法律制度的构建优化策略，包括定期修订和更新网络安全法律法规、加强网络安全监管机构的建设和执法力度、强化国际间的信息共享和法律协调以及开展网络安全教育和宣传等。这些策略旨在提升网络安全法律制度的适应性和有效性，以更好地应对网络安全挑战。本研究旨在通过深入研究网络安全法律制度的各个方面，为构建更加完善、有效的网络安全法律制度提供理论支持和实践指导。

Abstract
By deeply analyzing the theoretical basis, function and international practice of network security legal system, this study aims to comprehensively reveal the current situation and challenges of network security legal system. The study defines the connotation of the legal system of network security, and discusses its basic principles, including protecting the sovereignty of cyberspace, safeguarding national security, safeguarding social and public interests, and promoting the healthy development of the network. On this basis, the function and function of the network security legal system in maintaining the network security, promoting the healthy development of the network and protecting the citizens' rights and interests are further analyzed. By comparing the cyber security legal systems of the United States, the European Union, China and other countries and regions, this study finds that there are significant differences and commonalities in the cyber security legislation, law enforcement and international cooperation. At the same time, the research also reveals the problems existing in the construction of the current network security legal system, including legislation lag, implementation difficulties, lack of international cooperation and lack of public legal awareness. In view of these problems, this research puts forward the construction and optimization strategy of the network security legal system, including regular revision and updating of network security laws and regulations, strengthening the construction and law enforcement of network security regulatory agencies, strengthening international information sharing and legal coordination, and the development of network security education and publicity. These strategies are designed to improve the adaptability and effectiveness of cybersecurity legal systems to better address cybersecurity challenges. This study aims to provide theoretical support and practical guidance for the construction of a more perfect and effective network security legal system through the in-depth study of all aspects of the network security legal system.
