摘 要
本文旨在探讨公民基本权利和自由的保障问题。首先，文章从理论层面阐述了公民基本权利和自由的定义、分类及其在现代社会中的价值，强调了保障公民基本权利和自由对于促进民主与法治发展、保障个人尊严与自由的重要性。接着，文章分析了我国公民基本权利和自由保障在法律规定方面的现状，包括宪法、民事法律、刑事法律和行政法律的相关规定。然而，我国公民基本权利和自由保障在实践中仍存在一些问题。文章从立法不完善和可操作性差、执法和司法过程中的问题、违宪审查制度的不完善以及社会文化环境对公民权利自由的制约等方面进行了深入分析。针对这些问题，文章提出了一系列完善建议，包括完善相关法律法规，提高可操作性；加强执法和司法监督，确保公正执法；建立健全违宪审查制度；加强公民权利教育，提升权利意识等。本文认为，只有不断完善公民基本权利和自由的保障措施，才能更好地维护公民的合法权益，推动社会的公平与正义。同时，也需要加强公民权利教育，提升公民的权利意识，共同构建一个更加公正、和谐的社会。

Abstract
This paper aims to explore the protection of the citizens' fundamental rights and freedoms. First of all, the article expounds the definition and classification of citizens 'basic rights and freedoms and their value in modern society, emphasizing the importance of protecting citizens' basic rights and freedoms for promoting the development of democracy and the rule of law, and the protection of individual dignity and freedom. Then, the article analyzes the current situation of the basic rights and freedom protection of Chinese citizens in China, including the relevant provisions of the constitution, civil law, criminal law and administrative law. However, there are still some problems in the protection of basic rights and freedom in practice. The paper makes an in-depth analysis from the aspects of imperfect legislation and poor operability, the problems in the law enforcement and judicial process, the imperfection of the unconstitutional review system, and the restriction of civil rights and freedom by the social and cultural environment. In view of these problems, the paper puts forward a series of perfect suggestions, including improving the relevant laws and regulations, improving the operability; strengthening law enforcement and judicial supervision to ensure fair law enforcement; establishing and improving the unconstitutional review system; strengthening the education of civil rights, and enhancing the awareness of rights. This paper holds that only by constantly improving the safeguard measures of citizens' basic rights and freedoms can we better safeguard the legitimate rights and interests of citizens and promote social fairness and justice. At the same time, it is also necessary to strengthen civil rights education, enhance their awareness of rights, and jointly build a more just and harmonious society.
