工程造价纠纷是建筑行业中普遍存在的问题,其成因复杂且涉及多方面因素。随着我国建筑业的快速发展和法律法规体系的逐步完善,工程造价纠纷的法律风险日益凸显,成为影响项目顺利实施和行业健康发展的重要障碍。本研究旨在深入分析工程造价纠纷的主要成因,并探讨有效的法律风险防范措施。通过文献综述、案例分析及实证研究相结合的方法,本文系统梳理了合同条款不明确、市场价格波动、施工变更频繁以及管理不规范等关键因素对工程造价纠纷的影响。同时,结合具体案例剖析了当前法律框架下纠纷解决机制的不足之处。研究表明,加强合同管理、完善价格调整机制、优化变更流程以及提升从业人员法律意识是降低纠纷发生概率的关键策略。此外,本研究创新性地提出了基于大数据技术的动态造价监控模型,为实时预警和防范法律风险提供了技术支持。该模型能够有效整合市场信息与项目数据,为决策者提供科学依据。总体而言,本研究不仅揭示了工程造价纠纷的核心成因,还为相关方提供了具有实践指导意义的风险防控方案,对促进建筑行业的规范化发展具有重要意义。

ABSTRACT


Engineering cost disputes are a prevalent issue in the construction industry, with complex causes involving multiple factors. As China's construction sector rapidly develops and its legal and regulatory fr amework gradually improves, the legal risks associated with engineering cost disputes have become increasingly prominent, posing significant obstacles to the smooth implementation of projects and the healthy development of the industry. This study aims to conduct an in-depth analysis of the primary causes of engineering cost disputes and explore effective measures for mitigating legal risks. By integrating literature review, case analysis, and empirical research, this paper systematically examines the impacts of key factors such as ambiguous contract terms, market price fluctuations, frequent construction changes, and inadequate management on engineering cost disputes. Furthermore, it critically evaluates the inadequacies of dispute resolution mechanisms under the current legal fr amework through specific case studies. The findings indicate that enhancing contract management, refining price adjustment mechanisms, optimizing change order processes, and improving the legal awareness of professionals are critical strategies for reducing the likelihood of disputes. Additionally, this research innovatively proposes a dynamic cost monitoring model based on big data technology, providing technical support for real-time early warning and risk prevention. This model effectively integrates market information and project data, offering scientific evidence for decision-makers. Overall, this study not only uncovers the core causes of engineering cost disputes but also provides practical risk management solutions for relevant stakeholders, contributing significantly to the standardized development of the construction industry.
