摘 要
平等就业权是劳动者基本权利的重要组成部分,随着社会经济快速发展和就业市场竞争加剧,就业歧视现象日益凸显,严重侵害了劳动者的合法权益,影响社会稳定和谐,完善平等就业权法律保护体系迫在眉睫。本研究旨在构建更加完善的平等就业权法律保护体系,通过文献研究法梳理国内外相关法律法规及研究成果,运用比较分析法借鉴国外先进立法经验,结合我国国情深入剖析现行法律保护体系存在的缺陷,如立法原则抽象、受保护群体范围有限、救济途径不畅等。在此基础上提出创新性建议,包括明确细化立法原则,扩大受保护群体涵盖新型就业形态劳动者,构建多元化的救济机制整合行政救济与司法救济资源,强化用人单位社会责任意识并建立监督评估体系确保法律有效实施。研究结果表明完善后的法律保护体系能够更有效地预防和惩治就业歧视行为,保障劳动者平等就业权益,促进就业市场的公平竞争和社会的和谐稳定发展,为我国平等就业权法律保护提供了新的理论视角和实践路径。

Abstract
The right to equal employment opportunity is a critical component of workers' fundamental rights. As socioeconomic development accelerates and competition in the job market intensifies, instances of employment discrimination have become increasingly prominent, severely infringing upon workers' legitimate rights and affecting social stability and harmony. It is imperative to improve the legal protection system for equal employment rights. This study aims to construct a more comprehensive legal fr amework for protecting equal employment rights by employing literature review to examine relevant domestic and international laws and research findings. Comparative analysis is utilized to draw on advanced legislative experiences from abroad, while integrating China's national conditions to thoroughly analyze existing deficiencies in the current legal protection system, such as abstract legislative principles, limited scope of protected groups, and inadequate avenues for redress. Based on this analysis, innovative recommendations are proposed, including the clarification and refinement of legislative principles, expansion of protected groups to include workers in new forms of employment, establishment of a diversified relief mechanism that integrates administrative and judicial resources, enhancement of employers' social responsibility awareness, and creation of a supervision and evaluation system to ensure effective implementation of laws. The results indicate that the improved legal protection system can more effectively prevent and punish discriminatory practices in employment, safeguard workers' rights to equal employment opportunities, promote fair competition in the job market, and contribute to harmonious and stable social development, providing new theoretical perspectives and practical approaches for the legal protection of equal employment rights in China.
