网络侵权中的平台责任问题研究 -法学专业

摘要

随着互联网技术的迅猛发展，网络平台成为信息传播与交流的重要载体，但同时也引发了诸多侵权问题，如名誉权、肖像权、著作权等被侵犯，这不仅损害了权利人的合法权益，也扰乱了网络空间秩序。本研究旨在探讨网络侵权中的平台责任问题，以期为构建健康有序的网络环境提供理论支持。通过文献研究法梳理国内外相关研究成果，明确研究现状与不足；运用案例分析法深入剖析典型网络侵权案件中平台的行为模式及其责任承担情况；借助比较研究法借鉴国外先进立法经验。研究表明，在网络侵权事件中，平台并非完全置身事外，其在信息审核、用户管理等方面存在一定过失或疏忽时应承担责任。创新之处在于提出平台责任认定应综合考量平台性质、技术水平、侵权类型等因素，并构建包含预防机制、救济机制在内的平台责任体系，这有助于促使平台积极履行社会责任，从源头上减少侵权行为的发生，为完善我国网络侵权法律制度提供了新思路。

Abstract

With the rapid development of Internet technology, online platforms have become important carriers for information dissemination and communication. However, this has also led to various infringement issues, such as violations of rights to reputation, portrait, and copyright, which not only infringe upon the legitimate rights and interests of right holders but also disrupt the order of cyberspace. This study aims to explore the platform liability in cases of online infringement, providing theoretical support for the establishment of a healthy and orderly online environment. By employing literature review methods, this research examines existing domestic and international studies to identify current research status and deficiencies; through case analysis, it delves into the behavioral patterns and liability bearing situations of platforms in typical online infringement cases; and by using comparative research methods, it draws on advanced legislative experiences from abroad. The findings indicate that platforms are not entirely detached from online infringement incidents. When there are faults or negligence in aspects such as information review and user management, platforms should bear corresponding responsibilities. An innovative aspect of this study is the proposition that the determination of platform liability should take into account factors including the nature of the platform, technical capabilities, and types of infringement, and construct a platform liability system that includes preventive and remedial mechanisms. This can help encourage platforms to actively fulfill their social responsibilities, reduce the occurrence of infringement behaviors at the source, and provide new ideas for improving China's legal system concerning online infringement.
