  职务行为侵权中的单位责任问题日益成为法学研究与司法实践关注的焦点,随着社会经济快速发展,单位工作人员在执行工作任务过程中造成他人损害的情形愈发复杂多样,这不仅关乎受害人的权益保护,也涉及单位正常运营秩序的维护。本研究旨在深入探讨职务行为侵权中单位责任的认定标准、构成要件及责任承担方式等关键问题,以期为完善相关法律制度提供理论支持。通过文献分析法梳理国内外关于单位责任的立法规定与学术观点,运用案例分析法对我国司法实践中具有代表性的案件进行剖析,总结归纳出当前我国在职务行为侵权单位责任认定方面存在的主要问题,如责任主体界定模糊、归责原则适用不统一等。在此基础上,借鉴国外先进立法经验并结合我国国情提出构建明确的责任主体识别规则、确立无过错责任为主补充过错责任的归责体系以及合理确定赔偿范围与限额等创新性建议,从而实现受害人权益保障与单位利益平衡之间的有机统一,促进社会和谐稳定发展。

Abstract

  The issue of organizational liability for torts committed by employees in the course of their duties has increasingly become a focal point in legal research and judicial practice. As the socio-economic environment rapidly evolves, the scenarios in which employees cause harm to others while performing work tasks have become more complex and diverse. This not only concerns the protection of victims' rights but also involves maintaining the normal operational order of organizations. This study aims to delve into key issues surrounding the determination criteria, constitutive elements, and forms of liability assumption in cases of organizational liability for torts committed by employees. By employing literature analysis to review legislative provisions and scholarly perspectives both domestically and internationally, and through case analysis of representative cases in Chinese judicial practice, this research identifies major problems in the current recognition of organizational liability for employee torts in China, such as ambiguous definitions of liable parties and inconsistent application of fault principles. Building on these findings, this study draws upon advanced foreign legislative experiences and integrates them with China's national conditions to propose innovative recommendations, including establishing clear rules for identifying liable entities, adopting a liability system primarily based on strict liability supplemented by fault-based liability, and reasonably determining compensation scopes and limits. These measures aim to achieve an organic unity between protecting victims' rights and balancing organizational interests, thereby promoting harmonious and stable social development.
