摘 要
互联网技术的快速发展使得网络购物成为现代消费的关键部分,但消费者权益保护问题随之增加。本研究探讨了《消费者权益保护法》在网络购物环境中的适用性及挑战。通过系统分析现行法律法规和实际案例,揭示了网络购物中消费者权益保护的主要问题,如虚假宣传、商品质量、售后服务和信息安全等。研究结合文献分析和实证研究,深入分析了电商平台的运营模式、交易流程和监管机制。研究指出,《消费者权益保护法》在网络购物方面存在滞后,特别是在证据固定、举证责任和跨区域管辖方面。针对这些问题,文章提出了完善立法的建议,强调建立适应数字经济的新型监管体系,强化平台责任,优化消费者维权机制。本研究创新性地构建了“事前预防-事中监管-事后救济”的全流程保护框架,为网络购物消费者权益保护提供了理论和实践指导,对学术研究和现实具有重要意义。

Abstract
The rapid development of Internet technology makes online shopping become a key part of modern consumption, but the protection of consumer rights and interests increases accordingly. This study discusses the applicability and challenges of the Consumer Rights and Interests Protection Law in the online shopping environment. Through the systematic analysis of the current laws and regulations and actual cases, the main problems in the protection of consumer rights and interests in online shopping, such as false publicity, commodity quality, after-sales service and information security, are revealed. Combined with literature analysis and empirical research, the operation mode, transaction process and supervision mechanism of the e-commerce platform are deeply analyzed. The study points out that the Consumer Rights Protection Law lags behind in online shopping, especially in terms of fixed evidence, burden of proof and cross-regional jurisdiction. In view of these problems, the paper puts forward suggestions to improve the legislation, emphasizing the establishment of a new regulatory system adapted to the digital economy, strengthening the responsibility of the platform, and optimizing the mechanism of consumer rights protection. This research innovatively constructs the whole process protection fr amework of "pre-prevention-in-process supervision-post-relief", which provides theoretical and practical guidance for the protection of the rights and interests of online shopping consumers, and is of great significance to academic research and reality.
