摘 要
一般人格权与具体人格权作为人格权体系中的两类重要权利，其在理论构建与司法适用中存在诸多差异。随着现代社会的发展，人格利益的多元性与复杂性日益凸显，对二者进行比较研究具有重要的现实意义和理论价值。本研究旨在通过对一般人格权与具体人格权的概念、性质、功能等多方面深入剖析，揭示二者之间的区别与联系，为完善我国人格权法律制度提供理论支持。研究采用文献分析法、比较分析法等多种方法，系统梳理国内外相关研究成果，结合我国现行法律法规及司法实践案例展开探讨。结果表明，一般人格权具有高度概括性和兜底性，能够涵盖未被具体人格权明确列举的人格利益；而具体人格权则更侧重于对特定人格利益的保护，其内容明确且相对稳定。

Abstract
As two important types of rights in the personality right system, general personality right and specific personality right, there are many differences in the theoretical construction and judicial application. With the development of modern society, the diversity and complexity of personality interests are increasingly prominent, and the comparative study of the two has important practical significance and theoretical value. This study aims to reveal the difference and connection between the concept, nature and function of general personality rights and specific personality rights, and provide theoretical support for improving the legal system of personality rights in China. The research uses literature analysis, comparative analysis and other methods to systematically sort out the relevant research results at home and abroad, and discusses them combined with China's current laws and regulations and judicial practice cases. The results show that the general personality rights are highly generalized and supportive, and can cover the personality interests not explicitly listed by the specific personality rights, and they focus more on the protection of specific personality interests, which are clear and relatively stable.
