摘 要
随着社会快速发展，人格权保护面临诸多新挑战，传统具体人格权难以涵盖所有新型人格利益。本研究旨在探讨一般人格权的立法完善与发展趋势，通过文献分析、比较法研究及实证调查等方法，系统梳理国内外相关立法实践与理论成果。研究发现，一般人格权作为兜底性权利，在弥补具体人格权不足方面发挥着重要作用，其内涵涵盖人格独立、自由与尊严等人格核心价值。通过对德国、美国等国家立法经验的借鉴，结合我国国情，提出构建以宪法为基础，民法典为核心，特别法为补充的一般人格权立法体系。创新点在于强调一般人格权的动态发展特性，主张引入概括条款以适应不断变化的社会需求；建议设立司法解释机制，明确一般人格权的适用范围与边界，确保法律适用的统一性和可操作性。

Abstract
With the rapid development of the society, the protection of personality right is facing many new challenges, and it is difficult for the traditional specific personality right to cover all the new personality interests. The purpose of this study is to explore the legislative perfection and development trend of general personality right, and to systematically analyze the relevant legislative practice and theoretical achievements at home and abroad through literature analysis, comparative law research and empirical investigation. It is found that the general personality right, as the basic sexual right, plays an important role in making up for the lack of specific personality right, which covers the core values of personality, such as personality independence, freedom and dignity. Through the legislative experience of Germany, the United States and other countries, combined with China's national conditions, a legislative system of general personality right based on the constitution, the civil code as the core and special laws as the supplement. The innovation is to emphasize the dynamic development of general personality rights, advocate the introduction of general terms to meet the changing social needs; it is suggested to establish a judicial interpretation mechanism, clarify the application scope and boundary of general personality rights, and ensure the unity and operability of the application of law.
