随着房地产市场的增长,房屋交易量上升,但“一房二卖”问题也日益严重,影响市场和购房者权益。此现象违反公平原则,挑战法律权威。研究“一房二卖”的法律问题和对策对保护购房者权益、维护市场秩序、促进市场健康发展至关重要。本文探讨了房地产交易中的“一房二卖”问题,分析了其危害性和研究必要性,梳理了相关研究现状,概述了房地产交易的法律关系及“一房二卖”的性质和特征。文章深入分析了“一房二卖”的法律问题,包括法律漏洞、监管不足、购房者权益保护不力和司法难点。针对这些问题,提出了完善法律法规、加强监管和提升执行力、强化购房者权益保护等对策。期望本文能为相关立法和监管提供参考,推动房地产市场健康稳定发展。

Abstract
With the growth of the real estate market, the housing transaction volume has increased, but the problem of "one house, two sales" is also becoming increasingly serious, affecting the market and the rights and interests of home buyers. This phenomenon violates the principle of fairness and challenges the legal authority. It is very important to study the legal issues and countermeasures of "one house and two sales" to protect the rights and interests of home buyers, maintain the market order and promote the healthy development of the market. This paper discusses the problem of "one house and two sales" in real estate transactions, analyzes its harmfulness and the necessity of research, sorts out the relevant research status, and summarizes the legal relationship of real estate transactions and the nature and characteristics of "one house and two sales". The article makes an in-depth analysis of the legal issues of "one house and two sales", including legal loopholes, insufficient supervision, ineffective protection of the rights and interests of home buyers and judicial difficulties. In view of these problems, the paper puts forward countermeasures to improve laws and regulations, strengthen supervision and enhance enforcement, and strengthen the protection of the rights and interests of home buyers.
