数字时代智慧养老服务法治保障问题研究
摘 要
本文探讨法治保障在智慧养老服务中的重要作用，包括规范市场秩序、保障服务质量、保护老年人权益、推动技术创新等方面。针对当前智慧养老服务法治保障存在的问题，如法律法规体系不健全、监管机制不完善、老年人权益保护不到位以及技术创新与法律冲突等，本文提出了相应的完善对策。具体包括制定专门性法律法规、适时修订现有法律、明确监管主体与职责、强化数字化监管手段、完善隐私保护制度、畅通权益救济渠道、明确技术创新法律边界以及优化法律环境促进创新等。通过这些对策的实施，旨在为智慧养老服务的健康发展提供坚实的法治保障，促进老年人生活质量的全面提升。

Abstract
This paper discusses the important role of legal guarantee in the smart elderly care service, including standardizing the market order, ensuring the service quality, protecting the rights and interests of the elderly, and promoting technological innovation. In view of the current problems existing in the legal guarantee of intelligent elderly care service, such as the imperfect legal and regulation system, the imperfect supervision mechanism, the inadequate protection of the rights and interests of the elderly, and the conflict between technological innovation and law, this paper puts forward the corresponding perfect countermeasures. Specifically, it includes the formulation of specialized laws and regulations, timely revision of existing laws, clarifying the regulatory subjects and responsibilities, strengthening the digital supervision means, improving the privacy protection system, unblocking the channels of rights and interests relief, clarifying the legal boundary of technological innovation, and optimizing the legal environment to promote innovation. Through the implementation of these countermeasures, it aims to provide a solid legal guarantee for the healthy development of smart elderly care services, and promote the overall improvement of the quality of life of the elderly.

Abstract
This paper discusses the important role of legal guarantee in the smart elderly care service, including standardizing the market order, ensuring the service quality, protecting the rights and interests of the elderly, and promoting technological innovation.
