加强网络环境下肖像权保护的法律措施
摘 要
本文阐述了肖像权的法律定义及其在网络环境下的新特性，为后续研究奠定了理论基础。接着，本文分析了网络肖像权保护的重要性，指出其对于维护个人尊严与隐私、促进网络健康发展以及保障市场经济秩序的重要意义。在此基础上，本文提出了加强网络环境下肖像权保护的法律措施，包括立法层面的完善、执法与监管的强化、司法途径的创新以及社会教育与公众意识的提升等四个方面。通过深入分析现有法律措施的不足，本文提出了具体可行的改进建议，以期为构建更加完善的网络肖像权保护体系提供理论支持和实践指导。

Abstract
This paper expounds the legal definition of the portrait right and its new characteristics in the network environment, which lays a theoretical foundation for the subsequent research. Then, this paper analyzes the importance of the protection of network portrait rights, and points out its significance for maintaining personal dignity and privacy, promoting the healthy development of the network and ensuring the order of market economy. On this basis, this paper puts forward the legal measures to strengthen the protection of portrait right under the network environment, including four aspects: the improvement of the legislative level, the strengthening of law enforcement and supervision, the innovation of judicial channels, and the promotion of social education and public awareness. By deeply analyzing the shortcomings of the existing legal measures, this paper puts forward concrete and feasible improvement suggestions, in order to provide theoretical support and practical guidance for the construction of a more perfect network portrait right protection system.
