摘 要
随着网络直播行业的迅猛发展，直播打赏成为了一种新兴的互动方式，然而，使用赃款进行直播打赏的现象也逐渐浮出水面，引发了广泛的社会关注与法律讨论。本文旨在探讨使用赃款直播打赏的法律性质及其刑法规制的必要性与现存问题。在审视当前刑法规制现状时，本文揭示了法律规定不明确、司法实践挑战大、监管机制不足及公众认知与法律意识缺失等四大问题。针对这些问题，本文提出了完善法律规定、加强司法实践、强化监管机制及提升公众认知与法律意识的综合性建议。综上所述，本文为规范网络直播打赏行为、打击利用直播平台洗钱犯罪提供了理论依据与实践指导，对于维护网络空间安全、促进直播行业健康发展具有重要意义。

Abstract
With the rapid development of the network broadcast industry, live broadcast reward has become a new interactive way. However, the phenomenon of live broadcast reward using stolen money has gradually surfaced, which has triggered widespread social concern and legal discussion. The purpose of this paper is to discuss the legal nature and the necessity of criminal law regulation and the existing problems of using illicit money for live reward. When examining the current situation of criminal law regulation, this paper reveals four major problems, such as unclear legal provisions, great challenges in judicial practice, insufficient supervision mechanism, and lack of public cognition and legal consciousness. In view of these problems, this paper puts forward comprehensive suggestions to improve legal provisions, strengthen judicial practice, strengthen supervision mechanism and enhance public cognition and legal awareness. To sum up, this paper provides a theoretical basis and practical guidance for regulating the behavior of online live broadcasting and cracking down on money-laundering crimes using live broadcasting platforms, which is of great significance for maintaining the security of cyberspace and promoting the healthy development of the live broadcasting industry.
